Welcome to DOGMASH OS ("Service"). By creating an account or accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, please do not use the Service.

1. Data Storage & Privacy

By using DOGMASH OS, you consent to the storage and processing of the data you input (including but not limited to personal contacts, health records, litters, and financial sales data) on our secure servers located within the European Union. We implement reasonable technical and organizational security measures in accordance with the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679). The Service is provided "as is" and we cannot guarantee absolute data security against all unauthorized breaches.

2. Global Pedigree Database Contribution

A core feature of DOGMASH OS is building a comprehensive and interconnected canine network. By entering dogs, puppies, and litters into the Service, you explicitly agree that non-sensitive canine data (such as registered names, call names, breeds, colors, health test results, titles, and offspring relations) may become part of a global, centralized DogMash Pedigree Database. This allows us to generate extensive, accurate pedigrees and track genetics across different kennels and breeders within the DogMash ecosystem.

Note: Financial data (prices, contracts) and your private buyer contacts will always remain strictly confidential and visible only to you.

3. Intellectual Property

DOGMASH OS — including its software, source code, user interface design, visual assets, logos, trademarks, features, and documentation — is the exclusive intellectual property of DOGMASH and its developers, protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for the duration of your active subscription, solely for legitimate kennel management purposes. You may not copy, modify, distribute, sublicense, sell, or create derivative works from any part of the Service without explicit prior written consent.

All kennel data you enter into DOGMASH OS (dog records, health logs, litter data, financial records, buyer contacts) remains your property at all times. By submitting data to the Service, you grant DOGMASH a limited, non-exclusive license to store, process, and display that data solely in order to provide the Service to you.

4. Acceptable Use

You agree to use DOGMASH OS solely for lawful purposes related to dog breeding and kennel management. You must not: (a) upload, store, or transmit malicious code, malware, or disruptive content; (b) use the Service to harass, deceive, or harm any person or entity; (c) attempt to gain unauthorized access to other accounts, system components, or the database; (d) misrepresent your identity or kennel affiliation; or (e) use the Service in any manner that violates applicable local, national, or international law or regulation.

5. Automated Access, Scraping & Data Mining

Use of any automated means to access, monitor, copy, or extract data from DOGMASH OS — including but not limited to web crawlers, spiders, bots, scrapers, data-mining tools, or custom scripts — is strictly prohibited without our express prior written permission. This restriction applies to all parts of the Service, including the public pedigree tools, APIs, and any data the Service generates or exports.

You may not: (a) systematically harvest or download records from the pedigree database in bulk; (b) use extracted data for commercial redistribution, integration into competing products, or any purpose outside legitimate personal kennel management; (c) reverse engineer, decompile, or disassemble any component of the Service or its underlying database schema; or (d) circumvent any access controls, rate limits, or technical protection measures.

We actively monitor access patterns for signs of automated or abusive activity. Violations of this section may result in immediate account termination and/or civil or criminal legal action under applicable EU, national, and international law, including claims for damages caused by unauthorized data extraction.

6. Account Security & Responsibilities

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. You must not share your login details with third parties or permit others to access the Service under your account. If you become aware of any unauthorized use of your account, you must notify us immediately at support@dogmash.eu. DOGMASH OS shall not be liable for any loss or damage arising from your failure to protect your account credentials.

7. Subscriptions, Billing & Payment Processing

DOGMASH OS operates as a subscription-based Software as a Service (SaaS). All new accounts receive a full-featured 90-day free trial with no payment required upfront. Upon expiration of the trial period, continued access to the Service requires an active paid subscription. Available plans and billing cycles are listed on our official Pricing Page.

All prices are displayed in United States Dollars (USD) and are exclusive of any applicable value-added tax (VAT), goods and services tax (GST), sales tax, or equivalent local levies. Applicable taxes are calculated and added at the point of checkout based on your billing location.

Payments are currently processed by Gumroad, Inc., which acts as the Merchant of Record for all DOGMASH OS subscriptions and assumes responsibility for applicable tax calculation, collection, and remittance in relevant jurisdictions. We reserve the right to replace, add, or change payment processors at any time; such changes will be communicated with reasonable advance notice and will not affect the continuity of your access to the Service.

Subscriptions renew automatically at the end of each billing cycle. You may cancel at any time through your Gumroad account; access continues until the end of the current paid billing period. If a payment fails or a chargeback is initiated, access to the Service may be suspended until the matter is resolved.

The Service includes optional financial tracking tools (the Finance module) that let you record income, expenses, and other transactions related to your own kennel operations. These tools are provided solely for your own record-keeping convenience. DOGMASH OS does not calculate, withhold, report, or provide advice regarding any taxes, duties, or other levies applicable to your breeding business — such obligations vary significantly by jurisdiction and remain your sole responsibility. Please consult a qualified local accountant or tax advisor regarding your specific situation.

Refund Policy
Because DOGMASH OS provides a comprehensive, fully functional 90-day free trial before any payment is required, all subscription fees are final and non-refundable once charged. We do not provide prorated refunds for cancelled subscriptions or unused portions of any billing period. If you believe a billing error has occurred, please contact support@dogmash.eu within 14 days of the charge.

8. Service Availability

DOGMASH OS is provided on an "as is" and "as available" basis. While we strive for high service availability, we do not guarantee uninterrupted, error-free, or continuously secure access to the Service. Scheduled maintenance, hosting-provider outages, cyberattacks, force majeure events, or other circumstances outside our control may cause temporary unavailability. We reserve the right to modify, update, suspend, or discontinue any feature of the Service at any time, with reasonable advance notice where practicable.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOGMASH OS, ITS DEVELOPERS, AND OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, BUSINESS INTERRUPTION, LOSS OF REVENUE, OR MISCALCULATED BREEDING OR HEALTH DATES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. You are solely responsible for maintaining your own backups of critical kennel records.

10. Indemnification

You agree to indemnify, defend, and hold harmless DOGMASH OS, its developers, operators, and affiliates from and against any and all claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in a manner not authorized by these Terms; (b) your breach of any applicable law or third-party right; or (c) any data you submit to the Service that infringes the rights of any third party.

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When material changes are made, we will update the "Last Updated" date at the top of this page and, where significant changes are involved, notify active users by email or via an in-app notice. Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of the revised version. If you do not agree to the updated Terms, you must stop using the Service.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the European Union and applicable EU member state legislation, including but not limited to the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679). Mandatory consumer protection rights under applicable local law are not limited or waived by these Terms. We encourage you to resolve any disputes informally by contacting us at support@dogmash.eu. Disputes that cannot be resolved through direct communication shall be referred to the competent courts of the EU member state in which the service operator is established. Users located outside the EU acknowledge that by using the Service, they consent to the processing of their data within the EU.

13. Termination

We reserve the right to suspend or permanently terminate your access to DOGMASH OS, at our sole discretion and without prior notice, if: (a) you violate any provision of these Terms; (b) your activity poses a risk to the integrity, security, or performance of the Service; or (c) continued provision of the Service to your account is no longer feasible for technical, commercial, or legal reasons. Upon termination, your right to access the Service ceases immediately. You may request an export of your kennel data by contacting support@dogmash.eu within 30 days of account closure; data may be permanently deleted thereafter.
